By accessing or using DiscoTable ("Platform", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
DiscoTable is a marketplace platform that connects hospitality businesses with content creators for social media marketing purposes. We act solely as an intermediary and are not a party to any agreements between businesses and creators.
2. Eligibility
2.1 Age Requirements
- You must be at least 18 years old to use DiscoTable.
- By creating an account, you represent and warrant that you are at least 18 years of age.
2.2 Account Limitations
- Each user (creator or business) may maintain only one account.
- You may not create multiple accounts or allow others to use your account.
- Violation of this policy may result in immediate account termination.
2.3 Geographic Availability
- DiscoTable is available worldwide, subject to local laws and regulations.
- You are responsible for ensuring your use of the Platform complies with all applicable local laws.
3. Platform Services
3.1 Nature of Service
DiscoTable provides a platform for:
- Businesses to post campaigns seeking content creators
- Creators to discover and apply for campaigns
- Facilitation of payments between businesses and creators
- Content submission and approval workflows
3.2 No Guarantees
We do not guarantee any results, outcomes, earnings, views, engagement, or success from using the Platform.
- We do not guarantee the quality, safety, legality, or accuracy of any content, campaigns, or user interactions.
- We are not responsible for the conduct of any users, whether online or offline.
3.3 Platform Role
- DiscoTable acts solely as a marketplace and intermediary platform.
- We are not a party to any agreements between creators and businesses.
- We do not employ creators or businesses; all users are independent parties.
4. Creator-Specific Terms
4.1 Content Approval & Payment Accrual
IMPORTANT: Content accrual only begins once approved by admin.
- All submitted content must be reviewed and approved by DiscoTable admin before payment accrual begins.
- Submitted content does not guarantee approval or payment.
- Admin approval is required before any views or engagement are counted toward payment.
- Rejection of content does not entitle creators to compensation.
4.2 View-Based Payment Model
- Payment is calculated per verified view of approved content, up to the campaign's total budget.
- View counts are verified through official social media platform APIs and analytics.
- Only views on approved content posted to your linked social media accounts are counted.
- Payment rates are specified per campaign (e.g., $X per 1,000 views).
- Once a campaign budget is exhausted, no further payments accrue regardless of additional views.
4.3 No Guarantees
DiscoTable does not guarantee any views, engagement, earnings, or campaign success.
- We do not guarantee that your content will be approved.
- We do not guarantee any minimum earnings or payment amounts.
- We do not guarantee any specific number of views or engagement.
- Campaign budgets may be exhausted before your content reaches maximum potential views.
- Payment is contingent on verified views and available campaign budget.
4.4 Content Guidelines & Compliance
- Creators must follow all campaign instructions, requirements, and brand guidelines.
- Content must accurately represent the business and campaign objectives.
- Failure to follow guidelines may result in content rejection without compensation.
- Creators must comply with all applicable advertising disclosure laws (e.g., FTC guidelines, #ad, #sponsored).
- Content must be original and not infringe on any third-party rights.
4.5 Intellectual Property & Content License
Creators retain copyright ownership of their content.
- You retain all intellectual property rights to content you create and submit.
- By submitting approved content, you grant the business a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display the content for marketing and promotional purposes.
- The business may use approved content on their website, social media, advertising, and other marketing materials.
- This license continues for the duration specified in the campaign terms (typically 12 months unless otherwise stated).
- You may continue to use your content for your own purposes.
4.6 Fraud Prevention & Compliance
Artificial view inflation or fraudulent activity will result in immediate disqualification and forfeiture of all payments.
- Creators must not engage in any form of view manipulation, bot usage, or artificial engagement inflation.
- Purchasing views, likes, or followers is strictly prohibited.
- Engagement must be organic and genuine.
- DiscoTable reserves the right to audit view counts and engagement metrics.
- Violations will result in:
- Immediate account suspension or termination
- Forfeiture of all pending and accrued payments
- Potential legal action for fraud
- Permanent ban from the Platform
4.7 Payment Schedule & Processing
- Creator payments are processed weekly after content approval and view verification.
- Payments are made via bank transfer to your registered account.
- Minimum payout threshold: $50 (payments below this amount roll over to the next payment cycle).
- Payment processing may take 3-7 business days depending on your bank.
- You are responsible for providing accurate payment information.
- DiscoTable is not responsible for delays caused by incorrect payment details.
4.8 Payment Disputes
- All payment disputes must be submitted within 30 days of the disputed payment period.
- Disputes are resolved by DiscoTable admin at their sole discretion.
- View count verification is based on official social media platform analytics.
- Admin decisions on payment disputes are final and binding.
5. Business-Specific Terms
5.1 Campaign Budget & Payment Limits
Payments to creators accrue up to the total campaign budget only.
- You set a maximum budget when creating a campaign.
- Creator payments will not exceed your specified budget.
- Once the budget is exhausted, no further payments accrue regardless of additional views.
- You are responsible for funding the campaign budget before admin approval.
- DiscoTable charges a 10% platform fee on the total campaign budget.
5.2 Content Approval Process
- All creator content submissions are reviewed and approved by DiscoTable admin.
- Businesses may provide feedback on submitted content, but final approval authority rests with DiscoTable admin.
- Admin approval is based on:
- Compliance with campaign guidelines
- Content quality and appropriateness
- Adherence to Platform policies
- Business feedback (advisory, not binding)
- Businesses cannot directly approve or reject content; this is managed by DiscoTable to ensure fairness and quality standards.
5.3 View-Based Billing
- You are billed based on verified views of approved creator content.
- View counts are verified through official social media platform APIs.
- Billing occurs as views accumulate, up to your campaign budget.
- You will receive regular reports on view counts and budget utilization.
- DiscoTable is not responsible for view count discrepancies caused by social media platforms.
5.4 Campaign Termination & Pausing
- You may pause or terminate campaigns at any time through the Platform.
- Pausing a campaign stops new content submissions but does not affect approved content already posted.
- Terminating a campaign ends all activity, but accrued payments for approved content are still due.
- You remain obligated to pay for all views accumulated on approved content up to the termination date.
- Early termination does not entitle you to refunds of platform fees or budgeted amounts.
5.5 Content Use Rights & Licensing
Businesses receive a license to use approved content; copyright remains with the creator.
- Creators retain copyright ownership of all content they create.
- Upon content approval, you receive a non-exclusive, worldwide, royalty-free license to use the content for marketing and promotional purposes.
- You may use approved content on:
- Your website and social media channels
- Advertising and marketing materials
- Print and digital promotional content
- In-venue displays and signage
- License duration is typically 12 months from content approval unless otherwise specified in campaign terms.
- You must properly credit creators when required by campaign terms.
- You may not sublicense, sell, or transfer content rights to third parties without creator consent.
5.6 Fraud & Abuse Prevention
DiscoTable reserves the right to adjust or withhold payments if fraud, misuse, or abuse is detected.
- We monitor campaigns for fraudulent activity, including:
- Artificial view inflation
- Fake engagement or bot activity
- Collusion between businesses and creators
- Misrepresentation of campaign terms
- If fraud is detected, we may:
- Suspend or terminate your account
- Withhold or adjust payments
- Refund affected parties
- Take legal action
- You are responsible for ensuring all campaign activity is legitimate and compliant.
6. Platform Fees
6.1 Fee Structure
- DiscoTable charges a 10% platform fee on all campaign budgets.
- Platform fees are charged to businesses when campaigns are approved by admin.
- Fees are non-refundable except as required by law.
- Additional payment processing fees may apply based on payment method.
6.2 Payment Methods
- Business payments may be processed via bank transfer, credit card, or other payment processors.
- Creator payments are processed via bank transfer.
- Users are responsible for any fees charged by payment processors or banks.
7. Content Policy
5.1 Prohibited Content
Users may not post, submit, or share content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
- Infringes on intellectual property rights
- Contains hate speech, discrimination, or promotes violence
- Is sexually explicit or pornographic
- Promotes illegal drugs, weapons, or other illegal activities
- Contains false or misleading information
- Violates any applicable laws or regulations
5.2 Content Moderation
- DiscoTable reserves the right to review, moderate, remove, or reject any content at our sole discretion.
- We may, but are not obligated to, monitor content on the Platform.
- Content removal does not entitle users to refunds or compensation.
8. Dispute Resolution
8.1 Payment Disputes
- All payment disputes must be submitted to DiscoTable admin within 30 days of the disputed transaction.
- Disputes should be submitted via email to disputes@discotable.com with:
- Campaign ID and details
- Description of the dispute
- Supporting evidence (screenshots, analytics, etc.)
- DiscoTable admin will review disputes and make a final determination within 14 business days.
- Admin decisions are final and binding on all parties.
8.2 Content Disputes
- Disputes regarding content approval/rejection must be submitted within 7 days of the decision.
- Admin will review the content against campaign guidelines and Platform policies.
- Admin decisions on content approval are final.
8.3 Arbitration Agreement
By using DiscoTable, you agree to resolve disputes through binding arbitration.
- Any dispute arising from these Terms or use of the Platform shall be resolved through binding arbitration.
- Arbitration will be conducted under the rules of a mutually agreed arbitration service.
- You waive your right to participate in class action lawsuits or class-wide arbitration.
- Exceptions: Small claims court disputes and intellectual property disputes may be brought in court.
9. Disclaimers & Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE"
Without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISCOTABLE SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Personal injury or property damage
- Damages arising from user interactions, whether online or offline
- Damages arising from third-party conduct or content
- Damages arising from payment disputes, fraud, or unauthorized transactions
In no event shall DiscoTable's total liability exceed the amount of fees paid by you to DiscoTable in the 12 months preceding the claim, or $100, whichever is less.
10. Indemnification
You agree to indemnify, defend, and hold harmless DiscoTable, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any rights of third parties
- Your content or conduct on the Platform
- Any disputes between you and other users
11. Account Termination
11.1 Termination by User
- You may terminate your account at any time through account settings or by contacting support.
- Upon termination:
- Active campaigns will be paused or terminated
- Pending payments will be processed according to normal schedule
- You remain liable for any outstanding obligations
11.2 Termination by DiscoTable
- We may suspend or terminate your account immediately if you:
- Violate these Terms
- Engage in fraudulent activity
- Violate applicable laws
- Harm other users or the Platform
- Upon termination for cause, you forfeit all pending payments and benefits.
- We reserve the right to refuse service to anyone at our sole discretion.
12. Modifications to Terms
- We reserve the right to modify these Terms at any time, at our sole discretion.
- Changes will be effective immediately upon posting to the Platform.
- Continued use of the Platform after changes constitutes acceptance of modified Terms.
